1. Acceptance of Terms

By creating an account, booking a session, or using any part of EchoPsychology's platform, you agree to these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, please do not use our services.

2. Description of Service

EchoPsychology provides an online platform that connects clients with licensed mental health professionals for therapy services. Our services include:

• Therapist matching and profiles
• Secure video, phone, and messaging sessions
• Appointment scheduling and management
• Payment processing and insurance billing
• Clinical notes and resource access

Important: EchoPsychology is not a crisis service. If you are in immediate danger, call 911 or your local emergency services.

3. Eligibility

You must be at least 13 years old to use our services. Users between 13-17 require parental or guardian consent. By using our services, you represent that you meet these age requirements and have the legal capacity to enter into this agreement.

4. Account Registration

To use our services, you must:

• Provide accurate, current, and complete information during registration
• Maintain and update your information as needed
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized access
• Take responsibility for all activity under your account

5. Therapeutic Relationship

Independent Practitioners: Therapists on our platform are independent licensed professionals. EchoPsychology provides the technology platform but does not provide therapy services directly. The therapeutic relationship is between you and your therapist.

Professional Standards: All therapists must be licensed, follow ethical guidelines, and maintain professional standards of care. However, EchoPsychology does not guarantee specific treatment outcomes.

Therapist Matching: We strive to match you with appropriate therapists, but the decision to engage with a particular therapist is ultimately yours. You may request to change therapists at any time.

7. Cancellation Policy

• 24+ hours notice: Full refund, no penalty
• Less than 24 hours: 50% refund or credit
• No-show: Full session fee charged
• Therapist cancellation: Full refund and optional rescheduling

Emergencies and exceptional circumstances will be considered on a case-by-case basis.

8. User Conduct

You agree not to:

• Harass, abuse, or threaten therapists or staff
• Use the platform for illegal purposes
• Share your account credentials with others
• Attempt to access unauthorized areas of the platform
• Upload malware, viruses, or harmful code
• Misrepresent your identity or credentials
• Record sessions without explicit consent
• Use the platform to market or advertise

Violations may result in account suspension or termination.

9. Confidentiality and Privacy

Your privacy is protected under HIPAA and our Privacy Policy. Sessions are confidential, except when required by law (e.g., risk of harm to self or others, child abuse, court orders). See our Privacy Policy for complete details on how we handle your information.

10. Intellectual Property

All content on EchoPsychology (text, graphics, logos, software) is our property or our licensors'. You may not copy, modify, distribute, or create derivative works without written permission. Therapist-created materials remain their intellectual property.

12. Limitation of Liability

To the fullest extent permitted by law, EchoPsychology and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid us in the 12 months before the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless EchoPsychology from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the services or violation of these terms.

14. Termination

You may terminate your account anytime through your dashboard settings. We may suspend or terminate your account for violations of these terms, illegal activity, or abusive behavior. Termination does not relieve you of payment obligations for services already rendered.

15. Dispute Resolution

Informal Resolution: Please contact us first to try to resolve any disputes informally.

Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except for small claims court matters.

Governing Law: These terms are governed by the laws of California, United States, without regard to conflict of law provisions.

16. Changes to Terms

We may update these terms periodically. Material changes will be communicated via email or prominent notice. Continued use after changes constitutes acceptance. Check this page regularly for updates.

17. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full effect.

18. Entire Agreement

These terms, along with our Privacy Policy, constitute the entire agreement between you and EchoPsychology regarding use of our services.
